Welcome to Modern Express. These Terms and Conditions govern your use of our website and the purchase of products and services from Modern Express ("Company", "we", "us", or "our"). By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.

1. General

1.1 These Terms and Conditions apply to all products and services supplied by Modern Express.
1.2 We reserve the right to amend these Terms and Conditions at any time without prior notice. Any updates will be published on this page.
1.3 By using our website, requesting a quotation, or placing an order, you acknowledge that you have read, understood, and accepted these Terms and Conditions.

2. Quotations

2.1 All quotations are valid for 14 days unless otherwise stated.
2.2 Prices are subject to change after the quotation validity period has expired.
2.3 Quotations are based on the specifications provided by the customer. Any changes to specifications may result in revised pricing.

3. Orders

3.1 An order is considered confirmed only once payment has been received and written confirmation has been issued by Modern Express.
3.2 Customers are responsible for ensuring that all information, artwork, spelling, quantities, dimensions, and delivery details are accurate before approval.
3.3 Any changes requested after production has commenced may incur additional charges and may affect delivery timelines.

4. Artwork and File Submission

4.1 Customers are solely responsible for the content and accuracy of submitted artwork.
4.2 We are not liable for errors including, but not limited to:
* Spelling mistakes
* Incorrect contact information
* Low-resolution images
* Formatting errors
* Colour variations resulting from supplied files
4.3 We reserve the right to refuse artwork that contains unlawful, offensive, defamatory, or copyrighted material for which permission has not been obtained.
4.4 By submitting artwork, the customer warrants that they own the rights or have permission to reproduce all content provided.

5. Proof Approval

5.1 Digital proofs may be supplied where applicable.
5.2 Production will only commence after proof approval has been received.
5.3 Once a proof has been approved, the customer accepts full responsibility for any errors remaining in the artwork.
5.4 Reprints resulting from customer-approved errors will be charged at standard rates.

6. Colour and Print Variations

6.1 Due to differences in monitors, printers, materials, inks, and production processes, exact colour matching cannot be guaranteed.
6.2 Minor variations in colour, trimming, alignment, and finishing are considered acceptable within industry tolerances.
6.3 Such variations shall not constitute grounds for rejection, refund, or reprint.

7. Payment Terms

7.1 Full payment may be required before production begins unless otherwise agreed in writing.
7.2 For approved account holders, payment is due according to agreed credit terms.
7.3 Late payments may result in delayed production, delayed delivery, suspension of services, or legal action.
7.4 Ownership of all goods remains with Modern Express until full payment has been received.

8. Production and Turnaround Times

8.1 Turnaround times provided are estimates only and are not guaranteed.
8.2 Production times commence once:
* Payment has cleared;
* Final artwork has been received; and
* Proof approval has been granted where applicable.
8.3 We shall not be liable for delays caused by suppliers, couriers, equipment failure, power outages, force majeure events, or circumstances beyond our reasonable control.

9. Delivery

9.1 Delivery dates are estimates only.
9.2 Risk in the goods passes to the customer upon delivery or collection.
9.3 Customers must inspect goods upon receipt and notify us of any issues within 48 hours.
9.4 We are not responsible for delays, loss, or damage caused by third-party courier services once goods have been dispatched.

10. Returns, Refunds and Reprints

10.1 Due to the customised nature of printed products, orders are generally non-refundable and non-returnable.
10.2 Refunds or reprints will only be considered where:
* The product supplied differs materially from the approved proof;
* The product contains manufacturing defects; or
* An error occurred during our production process
10.3 Claims must be submitted in writing within 7 days of receipt and must include photographs or supporting evidence.
10.4 We reserve the right to inspect returned goods before approving any refund or reprint.

11. Intellectual Property


11.1 Customers retain ownership of their submitted artwork.
11.2 By submitting artwork, customers grant Modern Express licence to reproduce and process such artwork solely for the purpose of fulfilling the order.
11.3 All website content, logos, graphics, and branding belonging to Modern Express remain our intellectual property and may not be reproduced without written permission.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Modern Express shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services.
12.2 Our total liability for any claim shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

13. Privacy

13.1 Customer information will be handled in accordance with our Privacy Policy.
13.2 We will take reasonable steps to protect personal information in compliance with applicable South African data protection legislation.

14. Force Majeure


Modern Express shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, civil unrest, power failures, internet outages, supplier delays, pandemics, or government actions.

15. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
